Following are examples of some of the items we typically assess to help devise such a strategy:
- the technology concerned and potential scope of IP rights;
- existing contractual obligations and rights of third parties;
- the proposed use of the technology, e.g., develop in-house vs. licence out;
- the proposed timing and roll-out plan;
- procedures and agreements in place for the protection of confidential information;
- the territories of interest to you and/or potential licensees;
- the name under which the product will be marketed and scope of protection for same;
- potential distributors and/or licensees and their terms of appointment; and
- available budget.
